William JULIÉ explains how the opening of a trial for war crimes on a national level in Ukraine shows that the judicial institution continues to function despite the war. According to him, there is no need to fear expeditious justice from Ukraine, as this would be a bad choice of communication on their part and a violation of the rule of law. The opening of this trial by Ukraine is not contrary to the jurisdiction of the International Criminal Court, which remains a subsidiary mechanism, even if this Court has demonstrated its effectiveness, despite many criticisms.
