The guilty plea Lafarge negotiated in the US, admitting to funding terrorism in Syria, could prove to be a smart move for the French company as they could be able to invoke the ne bis in idem principle before the French courts where the company and its former managers are still indicted for the same offence, coupled to complicity of crimes against humanity. This move will however not prevent the company’s former CEO and other individuals prosecuted in that case as they were not part of the US guilty plea.
