
Maître William Julié provided legal clarification for Le Parisien on the legal regime of the European arrest warrant following the arrest of Mohamed Amra on 22 February 2025 by the Romanian authorities.
The European arrest warrant is a warrant issued by one state and circulated to all member states of the European Union. Arrest of the person concerned by one of the member states triggers a surrender procedure to the issuing state.
Maître Julié explained that Romania could, in theory, reject a request for surrender under several conditions, particularly if the person was also being prosecuted in the country to which the request was made.
Once Mohamed Amra is handed over to France, he will be heard and judged by the French justice system and it will no longer be possible for him to invoke any violation of his rights abroad before it.
