William JULIÉ explains the legal difficulties with the death penalties against the soldiers with respecting the Rule of Law. The soldiers did not benefit from the guarantees provided under the Geneva Convention. Furthermore, it seems like no recourse before the European Court of Human Rights is possible since Russia’s withdrawal from the Council of Europe. Time will tell if the Russian authorities will carry out the sanctions, that could also be used as leverage in other diplomatic discussions involving Russia.
